Eligibility. This Jackpocket 2024 New York Giants Game Sweepstakes (“Sweepstakes”) is open only to natural persons who are physically present in New Jersey or New York (“Participating Jurisdictions”) who are at least 18 years old at the time of entry, excluding individuals referenced in the “Sponsor” paragraph below.  Void outside of the Participating Jurisdictions, and where prohibited.  This Sweepstakes is subject to all applicable federal, state, and local laws and regulations.  By entering into this Sweepstakes, you agree to these Official Rules.

Sponsor. The Sweepstakes sponsor is Jackpocket LLC (“Sponsor”), located at 100 Park Ave, 16th Floor, New York, NY 10017.  Employees, consultants, independent contractors, officers, directors, agents, owners and representatives of Sponsor, New York Football Giants, Inc. (“NYG”), Giants Stadium LLC, the NFL Entities (defined as NFL Enterprises LLC, NFL Properties LLC, the National Football League, its member professional football clubs, NFL Ventures, Inc., NFL Ventures, L.P., NFL International LLC, NFL Productions LLC, NFL Players Association, NFL Players Incorporated and each of their respective affiliates, owners, subsidiaries, shareholders, officers, directors, partners, agents, representatives and employees, both individually and collectively), New Meadowlands Stadium Company (d/b/a MetLife Stadium), New Jersey Sports Exposition Authority, Metropolitan Life Insurance Company, Rock-GW, LLC, and each of their respective parents, affiliates, subsidiaries, agents, wholesalers, retailers, vendors, distributors, suppliers, advertising and promotion agencies (hereafter, collectively, “Released Parties”), and each such individual’s immediate family members (respective spouses, mother, father, sister, brother, step-siblings, children, step-children, grandparents, grandchildren, and step-grandchildren, regardless of where they reside) and those living in their same households, whether or not related, are not eligible to participate or win. The NFL Entities, NYG, Giants Stadium LLC and their respective affiliates will have no liability or responsibility for any claim arising in connection with participation in this Sweepstakes or any prize awarded. The NFL Entities, NYG, Giants Stadium LLC and their respective affiliates have not offered or sponsored this Sweepstakes in any way.

Entry Period.  This Sweepstakes begins on November 13, 2024 at 12:00:01 PM Eastern Time (“ET”) and ends on December 2, 2024 at 11:45 PM ET (“Entry Period”).  All times are measured by Eastern Time (“ET”).  The Sponsor’s database computer is the official timekeeping device for the Sweepstakes.  Each “day” for purposes of these Official Rules is measured by ET from 12:00:00 AM to and including 11:59:59 PM and means consecutive calendar days, including Saturdays, Sundays, and holidays, during the Entry Period.

How to Enter.  During the Entry Period, there are two ways to enter.

• Entry with Purchase Via App:  First, download or open the Jackpocket mobile application (the “App”) and navigate to the Giveaway Page in the App; second, tap ‘Activate’ for this Sweepstakes; and third, place an official national or state lottery ticket order on the App from the state lottery where you are physically located in one of the Participating Jurisdictions.  Every $1.00 spent on such ticket orders in the same account during the Entry Period after this Sweepstakes has been activated in that account is equal to one (1) entry in this Sweepstakes without need to activate again.  Tapping ‘Activate’ does not provide a discount to purchase and is used only to trigger and keep track of entries. For new users, placing an order will require downloading the App, opening and registering an account, and funding the account prior to placing the order.  All use of the App is subject to its general terms and conditions at jackpocket.com/tos.  Lottery ticket orders made using promotional credits and/or promotional funds will not provide any entries in the Sweepstakes for the amounts of such promotional credits and/or promotional funds.   

In order to enter with purchase via the App, you must have the following versions of iOS or Android, as applicable, installed: 

Jackpocket Android Version 2.13.7 or higher
Jackpocket iOS Version 2.13.8 or higher

• Free Entry via Website: You may also enter for free, without any purchase, by doing the following: First, download the App and open and register an account, which is free to do; and second, after creating your account, during the Entry Period, go to https://jackpocket.typeform.com/to/ICu6VuLI  (the “Site”), and complete the typeform located there with the following information: full name, mailing address and the email address you used to register your Jackpocket account.  Each time you properly complete and submit the typeform on the Site, you receive ten (10) entries, which is equal or greater than the average number of dollars currently spent per day by users of the App to purchase state lottery tickets. IMPORTANT: The email address that you enter in the typeform MUST match the email address that you used to register your Jackpocket account. If the email addresses do not match, then you will not receive any entries for the typeform on which the email addresses did not match. Upon successful completion of both of the steps noted hereunder, you do not need to fund your Jackpocket account in order to enter the Sweepstakes during the Entry Period and registering for a Jackpocket account is free.  

Limitations on Entries. LIMIT OF AN AVERAGE OF ONE HUNDRED (100) ENTRIES PER PERSON PER DAY DURING THE ENTRY PERIOD, REGARDLESS OF METHOD OF ENTRY, INCLUDING ANY COMBINATION OF ENTRIES GENERATED BY EITHER OR BOTH OF THE METHODS DESCRIBED ABOVE.  An entrant can receive more than one hundred (100) entries in any given day during the Entry Period, provided that their average number of entries per day (calculated by dividing their total number of entries by the number of days in the Entry Period) does not exceed one hundred (100). Any attempt to submit more than the stated limit on entries by any means, including but not limited to use of multiple accounts, identities, email addresses or otherwise is grounds for disqualification.  Each individual must submit his/her own entries.  No third-party entry or entry through any sweepstakes service is permitted.  Use of robotic or any other automated means of entry is strictly prohibited.

Winners and Prizes.  Two (2) winners will be chosen at random. Each winner will win the following prize: two (2) suite tickets to the New York Giants Home Game at MetLife Stadium in East Rutherford, New Jersey on Sunday December 15, 2024, which allows each winner and one (1) guest of that winner to occupy two seats in a suite.  Free food and beverages (both alcoholic and non-alcoholic) included. Travel (including, without limitation, transportation and lodging) is not included. Approximate retail value (“ARV”) to each winner: $450.00. ARV of all prizes awarded in the Sweepstakes: $900.00. Any difference between the stated approximate retail value and actual value of the prize will not be awarded.  All other expenses not specifically mentioned herein are solely each winner’s responsibility, including any applicable federal, state, and local taxes. Winner understands there are inherent risks involved in travel to and from, and attendance to, MetLife Stadium, and these risks may be present before, during, and after the event.  Winner agrees to accept the prize “as is” and entrants hereby acknowledge that the Released Parties are not in any manner responsible or liable for any warranty, representation, or guarantee relative to the prizes, including warranties provided exclusively by a prize supplier.

The winners and winners’ guests must conduct themselves at all times in a socially responsible, appropriate and well-behaved manner; NYG and/or MetLife Stadium may eject the winner(s) and/or a winner’s guest from MetLife Stadium if the winner(s) and/or a winner’s guest behave in an inappropriate, belligerent or unruly manner as determined by NYG and/or MetLife Stadium in their sole discretion; and, under such circumstances, the Released Parties shall NOT have any liability or obligation to the winners and/or any winner’s guest of any kind.  Additional terms and conditions may apply to MetLife Stadium and its surrounding events for which the Released Parties shall not be responsible or liable in any way for any cancellations, losses or damages. Winner is solely responsible for any applicable federal, state, and local taxes as a result of acceptance of the prize.  Sponsor shall provide each winner with applicable tax forms for withholding purposes and each winner must return to Sponsor a W9 or W-8 BEN tax form, as applicable, prior to receiving the prize, if any such forms are required to be provided by Sponsor. Prizes may be subject to tax withholdings as required by law. Winner is solely responsible for determining winner’s tax liability that is in addition to or different from that described in this section.  No substitution or transfer of prize except in Sponsor’s discretion; provided that if the advertised prize becomes unavailable for any reason, an alternate prize of comparable value may be awarded.  If a winner’s Jackpocket account is locked, excluded or otherwise inactive, winner must reactivate the account to use the credits. 

A Ticketmaster account is required to receive the prize. The Sweepstakes is in no way sponsored, administered or produced by Ticketmaster.

Drawing.  Winners will be selected in a random drawing from among all eligible entries collected during the Entry Period, taking place on or about December 3, 2024 at 11:00 AM ET.  Decisions of the judges are final and binding on all matters relating to the Sweepstakes and these Official Rules.  Any entrant or potential winner may be disqualified and forfeit prize if they are not eligible or violate a rule, gained unfair advantage in the Sweepstakes, or obtained winner status using fraudulent means.  If there is a dispute about the identity of an entrant, prize will be awarded to the natural person associated with the Jackpocket account or provided by email.  If a winner is found to be ineligible or not in compliance with Sweepstakes rules, such winner will be disqualified and an alternate winner will be awarded the prize.  Winners will be notified by telephone and/or email using information associated with their Jackpocket accounts.  Inability of Sponsor to contact winner by telephone and/or email within seventy-two (72) hours after selection may result in disqualification of such winner and an alternate winner may be selected in a random drawing in Sponsor’s sole discretion. If any prize is returned as undeliverable, then such prize will be forfeited and another winner may be randomly drawn.  Each potential winner may be required to execute an Affidavit of Eligibility, a Liability Release, and (where legal) a Publicity Release; failure to comply when requested may result in disqualification and award of prize to an alternate winner.

Odds.  The odds of winning will depend on the number of eligible entries received.

WARNING: ANY ATTEMPT BY ANY PERSON, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER WITH OR VANDALIZE ANY SPONSOR-OWNED WEBSITE OR MOBILE APPLICATION OR RELATED SOCIAL NETWORKING SITE, THE ENTRY PROCESS, OR OTHERWISE INTERFERE WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

General Terms.  By entering this Sweepstakes, you promise to abide by the Official Rules and decisions of the Sweepstakes judges.  The Released Parties will not be responsible for any injury, damage, or loss of any kind arising out of your participation in or accessing or downloading information in connection with the Sweepstakes.  By entering, you agree to release, discharge, defend, indemnify and hold harmless the Released Parties, and any other person and organization responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes, and all of their respective past and present parents, affiliates, officers, directors, employees, agents and representatives  from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to your participation in or preparation for the Sweepstakes or any travel activity related thereto, or acceptance or misuse of any prize.

The Released Parties are not responsible for: late, lost, stolen, damaged, garbled, incomplete, illegible, inaccurate, misdirected or undelivered entries or communications; errors, omissions, interruptions, deletions, defects, or delays in operations or transmission of information; data corruption, theft, destruction, unauthorized access to or alteration of entry materials or communications; interruptions in service and failures or malfunctions of connections, satellite, network, cable, internet service provider(s), phones, phone lines or telephone systems; traffic congestion on the internet and technical or mechanical malfunctions; printing, typographical, and human errors appearing in these Official Rules or other Sweepstakes-related materials; electronic communications that are undeliverable because of any form of active or passive filtering or insufficient space in an entrant’s email account; and other errors otherwise relating to or in connection with this Sweepstakes, the administration thereof, the processing of entries, and the announcement of any prize or winner.  

Except where prohibited by law, by accepting the prize, each winner grants Sponsor a perpetual, worldwide, royalty-free license to use winner’s name, photograph, voice and/or likeness without further authorization, compensation, or remuneration of any kind for advertising, promotion and other publicity purposes in any and all media now or hereafter known throughout the world, including, without limitation, in social media advertisements and announcements.

Sponsor reserves the right to modify, extend, suspend, or terminate the Sweepstakes, in whole or in part, if it determines, in its sole discretion, that the Sweepstakes is technically impaired or corrupted or that fraud or technical problems, viruses, bugs, failures or malfunctions or other unintended circumstances have impaired the integrity, administration, security, proper play and/or feasibility of the Sweepstakes as contemplated herein.  If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select winner(s) in a random drawing from all eligible, non-suspect entries unaffected by the problem.  Inclusion in such drawing shall be each entrant’s sole and exclusive remedy in such circumstances. 

Only the type and quantity of prizes described in these Official Rules will be awarded.  If, for any reason, more bona fide winners come forward seeking to claim prizes in excess of the number of each type of prize set forth in these Official Rules, the winners, or remaining winners, as the case may be, of the advertised number of prizes available in the prize category in question may be selected in a random drawing from among all persons making purportedly valid claims for such prize(s).  Inclusion in such drawing shall be each entrant’s sole and exclusive remedy in such circumstances.

By entering the Sweepstakes, you further agree that (a) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prize awarded, shall be resolved individually without resort to any form of class action; (b) any claims, judgments and awards shall be limited to reasonable and actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorney's fees; and (c) under no circumstances will you be permitted to obtain any award for, and you hereby waive all rights to claim, punitive, incidental, indirect or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for reasonable and actual out-of-pocket expenses.  These rules and any disputes relating hereto are governed by the internal laws of the State of New York without regard to principles of conflicts of laws, and by entering, you consent to the exclusive jurisdiction of the state and federal courts in the State of New York for resolution of any disputes relating to the Sweepstakes and waive any objection thereto.

Sponsor may collect personal information when you enter.  Please refer to Sponsor’s privacy policy at https://jackpocket.com/privacy for how Sponsor uses and treats personal information.

Winner’s Name.  For the winners’ names, available approximately 15 days after the Entry Period closes, please visit the Giveaway Page in the App or contact Sponsor by email at jp-giveaways@draftkings.com and include the name of the Sweepstakes in your email.  All such requests must be received within 60 days after the Entry Period.
