Official Rules

Eligibility. This Free Play Friday Challenge is open to all natural persons who are legal residents of Arizona, Arkansas, Colorado, Idaho, Minnesota, Montana, New Hampshire, New Jersey, New Mexico, New York, Ohio, Oregon, Texas, Washington DC, and West Virginia who are at least 18 years old at the time of entry and at least 21 years old in Arizona. Void outside of Arizona, Arkansas, Colorado, Idaho, Minnesota, Montana, New Hampshire, New Jersey, New Mexico, New York, Ohio, Oregon, Texas, Washington DC, and West Virginia. This Challenge is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law.

Sponsor. The Challenge sponsor is Jackpocket Inc. (“Sponsor”), located at 145 W 45th St, Floor 12, New York, New York 10036.  Sponsor and its respective affiliates, subsidiaries, successors, assigns, agents, representatives, officers, directors, shareholders, and employees and any entity involved in the development, production, implementation, administration, judging or fulfillment of the Challenge, including without limitation, the immediate family members of such individuals, are not eligible to participate.  Sponsor will conduct the Challenge substantially as described in these Official Rules. 

This Challenge is in no way sponsored, endorsed, administered by or associated with Facebook. Facebook is completely released of all liability by each entrant in this Challenge.

Entry Period.  This Challenge begins on Friday, February 20 at 5:00 PM ET and ends on Friday, February 24 2023 at 5:00 PM ET (“Entry Period”).

How to Enter.  To enter the Challenge, you'll first need to become a registered user of www.Facebook.com (“Facebook”) or log into your Facebook account.  If you do not have an account, go to www.Facebook.com to create one. Facebook accounts are free. By submitting your information and creating a Facebook account, you agree to the Facebook Terms of Use and Privacy Notice. If you do not agree to such Terms of Use and Privacy Notice, you cannot create a Facebook account, or participate in this Challenge.  

During the Entry Period, (i) login to your Facebook account, (ii) follow @jackpocket, (iii) locate @jackpocket’s pinned Challenge Post (the “Challenge Post”), and (iv) follow and complete the Challenge rules in the post to receive one (1) entry, which consists of replying to the question prompt, and following @jackpocket.  Entry is free.  Entries on Facebook must be completed by Friday, February 24 2023 at 5:00 PM ET to be considered.

By submitting an entry as instructed through the above method (“Submission”), you agree that your Submission conforms to the Guidelines and Restrictions detailed below.  Sponsor may choose to remove any Submission or disqualify you from the Challenge if it believes that your Submission fails to conform with the Guidelines and Restrictions.  Upon completion of entry steps and compliance with the Guidelines and Restrictions, you will automatically receive one (1) entry into the Challenge. 

Entrants understand that they are posting their Submission at their sole risk.  Sponsor is not responsible for any claims arising from the Submission, specifically including, but not limited to, claims for intellectual property infringement and privacy rights violations, as well as violations of the respective social media platform’s terms and conditions.

Submission Guidelines and Restrictions

a. Your Submission must not supply untruthful, incomplete, inaccurate or misleading information.

b. Your Submission must be your original creation and be owned 100% by you, or, alternatively, you must have the full rights to grant the license and other rights that you grant to Sponsor below.

c. Your Submission must not (in Sponsor’s discretion):  (i) violate any third-party rights, including copyrights, trademark rights, or rights of privacy and publicity; (ii) contain disparaging or defamatory statements; (iii) include threats to any person, place, business, or group; (iv) be obscene, offensive, or indecent; (v) depict any risky behavior; (vi) contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; and/or (vii) contain unauthorized third-party trademarks or logos.

d. You represent and warrant that:  (i) the Submission does not violate any applicable law, rule or regulation; (ii) to the extent the Submission depicts any individual or features the voice or other qualities of any individual, you are the individual pictured, heard, or otherwise featured in the Submission, or, alternatively, that you have obtained written permission from each person appearing in the entry to grant the rights to Sponsor described in these Official Rules, and will make written copies of such permissions available to Sponsor upon request; (iii) the Submission complies with the Facebook terms of use; and (iv) the Submission complies with all requirements of these Official Rules.  

If participating in this Challenge via your mobile device (which service may only be available via select devices and participating wireless carriers, and is not required to enter), you may be charged for standard data use from your mobile device according to the terms in your wireless service provider’s data plan.  Normal airtime and carrier charges and other charges may apply to data use and will be billed on your wireless device bill or deducted from your pre-paid balance.  Wireless carrier rates vary, so you should contact your wireless carrier for information on your specific data plan.

Limitations on Entries. LIMIT ONE ENTRY, PER PERSON.  No third party entry or entry through any sweepstakes or other service is permitted.  Any person who attempts or otherwise encourages the entry of multiple or false contact information under multiple identities or uses any device or artifice to enter or encourage multiple or false entries, as determined by Sponsor, will be disqualified.  Use of robotic entry devices is strictly prohibited.  

Winners and Prizes.  

The following prizes are available during the Entry Period:

Winner agrees to accept the prize “as is” and entrants hereby acknowledge that Sponsor is not in any manner responsible or liable for any warranty, representation, or guarantee relative to the prizes, including warranties provided exclusively by a prize supplier.  

Winner Selection; Drawing.

• The prize will be selected in a random drawing from among all eligible entries collected during the Entry Period, taking place on or about Monday, February 20.  The drawing will be conducted by Jackpocket, whose decisions and interpretations on all matters relating to the Challenge and these Official Rules are final and binding in all respects.  

Sponsor reserves the right to disqualify any entrant or winner and may refuse to award a prize to a person who is not eligible or has violated a rule, gained unfair advantage in the Challenge, or obtained winner status using fraudulent means.  If there is a dispute about the identity of an entrant, prize will be awarded to the natural person associated with the account or provided by email; provided, that, if a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible.  If a winner is found to be ineligible or not in compliance with Challenge rules, such winner will be disqualified and an alternate winner will be awarded the prize in a separate random drawing. Winners will be notified by phone and/or email.  Inability of Sponsor to contact a winner by telephone within forty-eight (48) hours after selection may result in disqualification of such winner and an alternate winner may be selected in a random drawing as Sponsor’s discretion.  

Prize will be mailed to winner by mail at the mailing address provided by winner to Sponsor within five (5) business days after such winner has been notified and accepted the prize.  If a prize is returned as undeliverable, then such prize will be forfeited and another winner may be randomly drawn.

Odds.  The odds of winning will depend on the number of eligible participants, according to the eligibility requirements in the Challenge.

WARNING: ANY ATTEMPT BY ANY PERSON, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER WITH OR VANDALIZE ANY SPONSOR-OWNED WEBSITE OR MOBILE APPLICATION OR RELATED SOCIAL NETWORKING SITE, THE ENTRY PROCESS, OR OTHERWISE INTERFERE WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE CHALLENGE, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

General Terms.  By entering this Challenge, you promise to abide by the Official Rules and decisions of Sponsor, which will be final and binding in all respects.  Sponsor reserves the right, at its sole discretion, to refuse, disqualify, or withdraw any entry at any time.  Sponsor will not be responsible for any injury, damage, or loss of any kind arising out of your participation in the Challenge.  You agree to defend, indemnify, release and hold harmless the Sponsor and its subsidiary, and affiliated companies, and any other person and organization responsible for sponsoring, fulfilling, administering, advertising or promoting the Challenge, and all of their respective past and present parents, affiliates, officers, directors, employees, agents and representatives from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Challenge, acceptance, possession, attendance at, defect in, delivery of, inability to use, use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry. Winners acknowledge that the prize is awarded as-is without warranty of any kind.  

Except where prohibited by law, by accepting the prize, winner grants Sponsor a perpetual, worldwide, royalty-free license to use winner’s name, photograph, voice and/or likeness without further authorization, compensation, or remuneration of any kind for advertising, promotion and other publicity purposes in any and all media now or hereafter known throughout the world, including, without limitation, in social media advertisements and announcements.

Winner’s Name.  The names of winners are available only for thirty (30) days after the close of the Challenge.  To receive the names of winners, where permitted by law, or printed copy of the Challenge Official Rules, please contact Sponsor by email at socialcontest@jackpocket.com.

The Sponsor reserves the right to withdraw, terminate or modify the Challenge at any time without prior notice.
