Eligibility. This “Big Movie Giveaway” Sweepstakes (“Sweepstakes”) is open only to natural persons who are physically present in Arizona, Arkansas, Colorado, Idaho, Massachusetts, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, New Mexico, New York, Ohio, Oregon, Puerto Rico, Texas, Washington DC and West Virginia (“Participating Jurisdictions”) who are at least 18 years old (21 years old in Arizona and 19 years old in Nebraska) at the time of entry, excluding individuals referenced in the “Sponsor” paragraph below.  Void outside of the Participating Jurisdictions, and where prohibited.  This Sweepstakes is subject to all applicable federal, state, and local laws and regulations.

 

Sponsor. The Sweepstakes sponsor is Jackpocket Inc. (“Sponsor”), located at 100 Park Ave, 16th Floor, New York, NY 10017.  Sponsor and its affiliates, subsidiaries, successors, assigns, agents, and any entity involved in the development, production, implementation, administration, judging or fulfillment of the Sweepstakes, and their respective representatives, officers, directors, shareholders, members and employees, including without limitation, the immediate family and/or household members of such individuals, are not eligible to participate.   

 

Entry Period.  This Sweepstakes begins on February 22, 2024 at 12:00:01 AM Eastern Time (“ET”) and ends on March 29, 2024 at 11:59:59 PM ET (“Entry Period”).  All times are measured by Eastern Time (“ET”).  The Sponsor’s database computer is the official timekeeping device for the Sweepstakes.  Each “day” for purposes of these Official Rules is measured by ET.

 

How to Enter.  During the Entry Period, there are two ways to enter.

 

• Entry with Purchase Via App:  First, download or open the Jackpocket mobile application (the “App”) and navigate to the Giveaway Page in the App; second, tap ‘Activate’ for this Sweepstakes; third, place an official state lottery ticket order on the App from the state lottery where you are physically located in one of the Participating Jurisdictions; and fourth, submit an Oscar’s ballot, as detailed below.  Every $1.00 spent on such ticket orders in the same account during the Entry Period after this Sweepstakes has been activated in that account is equal to one (1) entry in this Sweepstakes without need to activate again.  Tapping ‘Activate’ does not provide a discount to purchase and is used only to trigger and keep track of entries. For new users, placing an order will require downloading the App, opening and registering an account, and funding the account prior to placing the order.  All use of the App is subject to its general terms and conditions at jackpocket.com/tos.  Lottery ticket orders made using promotional credits and/or promotional funds will not provide any entries in the Sweepstakes for the amounts of such promotional credits and/or promotional funds.  Lottery ticket orders made for scratch games (e.g., scratchers) will not provide any entries in the Sweepstakes for the amounts of such lottery ticket orders made for scratch games.

 

In order to enter with purchase via the App, you must have the following versions of iOS or Android, as applicable, installed:  

 

Jackpocket Android Version 2.13.7 or higher

Jackpocket iOS Version 2.13.8 or higher

• Free Entry via Website: You may also enter for free, without any purchase, by doing the following: First, download the App and open and register an account, which is free to do; second, after creating your account, during the Entry Period, go to https://jackpocket.typeform.com/to/AOzToDn7 (the “Site”), and complete the typeform located there with the following information: full name, phone number, mailing address and the email address you used to register your Jackpocket account; and third, submit an Oscar’s ballot, as detailed below.  Each time you properly complete and submit the typeform on the Site, you receive ten (10) entries, which is equal or greater than the average number of dollars currently spent per day by users of the App to purchase state lottery tickets. IMPORTANT: The email address that you enter in the typeform MUST match the email address that you used to register your Jackpocket account. If the email addresses do not match, then you will not receive any entries for the typeform on which the email addresses did not match. Upon successful completion of both of the steps noted hereunder, you do not need to fund your Jackpocket account in order to enter the Sweepstakes during the Entry Period and registering for a Jackpocket account is free.   

Oscars Ballot. Once you have entered the Sweepstakes via one of the two entry methods above, Sponsor will send you an email with a link to an Oscar’s ballot (the “Ballot”), which needs to be filled out and submitted to be eligible for a prize. All fields on the Ballot must be completed, including but not limited to the five questions about the Oscars. Regardless of the number of entries you have in the Sweepstakes, you will receive one Ballot. For the sake of clarity, a user will not be eligible to win any prizes unless they have completely filled out and submitted their Ballot.

 

Limitations on Entries. LIMIT OF ONE HUNDRED (100) ENTRIES PER PERSON PER DAY DURING THE ENTRY PERIOD, REGARDLESS OF METHOD OF ENTRY, INCLUDING ANY COMBINATION OF ENTRIES GENERATED BY EITHER OR BOTH OF THE METHODS DESCRIBED ABOVE.  Any attempt to submit more than the stated limit on entries by any means, including but not limited to use of multiple accounts, identities, email addresses or otherwise is grounds for disqualification.  Each individual must submit his/her own entries.  No third-party entry or entry through any sweepstakes service is permitted.  Use of robotic or any other automated means of entry is strictly prohibited.

 

Winners and Prizes.  Fifteen (15) winners will be chosen.  The winners and prizes are as follows:  

The total ARV of all prizes available for award is $1,800.00. Prizes awarded in the form of AMC Theatres Gift Cards that the winners can use at AMC Theatres. AMC Theatres is a registered trademark of AMC, Inc., which is not a sponsor of or associated in any way with this Sweepstakes.

 

Limit of one (1) prize per person.

 

Winners are solely responsible for any applicable federal, state, and local taxes as a result of acceptance of the prize.  Sponsor shall provide winners with applicable tax forms for withholding purposes and winners must return to Sponsor a W9 or W-8 BEN tax form, as applicable, prior to receiving the prize, if any such forms are required to be provided by Sponsor. Prizes may be subject to tax withholdings as required by law. Winners are solely responsible for determining such winner’s tax liability that is in addition to or different from that described in this section. No substitution or transfer of prize except in Sponsor’s discretion; provided that if the advertised prize becomes unavailable for any reason, an alternate prize of comparable value may be awarded.  If a winner’s Jackpocket account is locked, excluded or otherwise inactive, winner must reactivate the account to use the credits.  

 

Drawing.  Winners will be selected in random drawings on or about five (5) business days after the end of the Entry Period as follows:

 

• Grand Prize winner will be selected from among all eligible entries collected during the Entry Period that belong to users that answered all Ballot questions correctly.

• Second Place winners will be selected from among all eligible entries collected during the Entry Period that belong to users that answered four out of five Ballot questions correctly.

• Third Place winners will be selected from among all eligible entries collected during the Entry Period that belong to users that answered three out of five Ballot questions correctly.

• Fourth Place winners will be selected from among all eligible entries collected during the Entry Period that belong to users that answered two out of five Ballot questions correctly.

• Fifth Place winners will be selected from among all eligible entries collected during the Entry Period that belong to users that answered one out of five Ballot questions.

 

To the extent there are no users that answered five, four, three, two and/or one out of five Ballot questions correctly, the Grand Prize winner, Second Prize winners, Third Prize winners, Fourth Prize winners, and Fifth Prize winners will be selected from among all eligible entries collected during the Entry Period that belong to users that answered the most, second most, third most, fourth most and fifth most Ballot questions correctly, respectively; in this scenario, the prizes meant to be selected from among all eligible entries collected during the Entry Period that belong to users that answered the least (and/or second least, third least, fourth least or fifth least) Ballot questions correctly, will be selected from among all eligible entries collected during the Entry Period that belong to users that answered zero out of five Ballot questions correctly. For the sake of clarity and for illustration purposes only: 

 

• If there are no users that answered all Ballot questions correctly, the Grand Prize winner will be selected from among all eligible entries collected during the Entry Period that belong to users that answered four out of five Ballot questions correctly, the Second Prize winners will be selected from among all eligible entries collected during the Entry Period that belong to users that answered three out of five Ballot questions correctly, the Third Prize winners will be selected from among all eligible entries collected during the Entry Period that belong to users that answered two out of five Ballot questions correctly, the Fourth Prize winners will be selected from among all eligible entries collected during the Entry Period that belong to users that answered one out of five Ballot questions correctly, and the Fifth Prize winners will be selected from among all eligible entries collected during the Entry Period that belong to users that answered zero out of five Ballot questions correctly.

• If there are no users that answered five, four, three or two out of five Ballot questions correctly, the Grand Prize winner will be selected from among all eligible entries collected during the Entry Period that belong to users that answered one out of five Ballot questions correctly, and the Second Prize, Third Prize, Fourth Prize and Fifth Prize winners will be selected from among all eligible entries collected during the Entry Period that belong to users that answered zero out of five Ballot questions correctly..

• If there are no users that answered any Ballot questions correctly, the Grand Prize, Second Prize, Third Prize, Fourth Prize and Fifth Prize winners will be selected from among all eligible entries collected during the Entry Period.

 

Decisions of the judges are final and binding on all matters relating to the Sweepstakes and these Official Rules.  Any entrant or potential winners may be disqualified and forfeit prize if they are not eligible or violate a rule, gained unfair advantage in the Sweepstakes, or obtained winner status using fraudulent means.  If there is a dispute about the identity of an entrant, prize will be awarded to the natural person associated with the Jackpocket account or provided by email.  If a winner is found to be ineligible or not in compliance with Sweepstakes rules, such winner will be disqualified and an alternate winner will be awarded the prize.  Each potential winner will be notified by in-app message and/or email using information associated with their Jackpocket account. If any prize is returned as undeliverable, then such prize will be forfeited and another winner may be randomly drawn.  Each potential winner may be required to execute an Affidavit of Eligibility, a Liability Release, and (where legal) a Publicity Release; failure to comply when requested may result in disqualification and award of prize to an alternate winner.

 

Odds.  The odds of winning will depend on the number of eligible entries received and the number of correct answers on the Ballot.

 

WARNING: ANY ATTEMPT BY ANY PERSON, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER WITH OR VANDALIZE ANY SPONSOR-OWNED WEBSITE OR MOBILE APPLICATION OR RELATED SOCIAL NETWORKING SITE, THE ENTRY PROCESS, OR OTHERWISE INTERFERE WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

 

General Terms.  By entering this Sweepstakes, you promise to abide by the Official Rules and decisions of the Sweepstakes judges.  Sponsor will not be responsible for any injury, damage, or loss of any kind arising out of your participation in the Sweepstakes.  By entering, you release and agree to hold harmless the Sponsor and its subsidiary, and affiliated companies, and any other person and organization responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes, and all of their respective past and present parents, affiliates, officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to your participation in the Sweepstakes other than any obligation to award a prize in accordance with these Official Rules. 

 

Except where prohibited by law, by accepting the prize, winner grants Sponsor a perpetual, worldwide, royalty-free license to use winner’s name, photograph, voice and/or likeness without further authorization, compensation, or remuneration of any kind for advertising, promotion and other publicity purposes in any and all media now or hereafter known throughout the world, including, without limitation, in social media advertisements and announcements.  

 

Sponsor reserves the right to modify, extend, suspend, or terminate the Sweepstakes, in whole or in part, if it determines, in its sole discretion, that the Sweepstakes is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other unintended circumstances have impaired the integrity, administration, security, proper play and/or feasibility of the Sweepstakes as contemplated herein.  If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select winner(s) in a random drawing from all eligible, non-suspect entries unaffected by the problem.  Inclusion in such drawing shall be each entrant’s sole and exclusive remedy in such circumstances.  

 

Only the type and quantity of prizes described in these Official Rules will be awarded.  If, for any reason, more bona fide winners come forward seeking to claim prizes in excess of the number of each type of prize set forth in these Official Rules, the winner, or remaining winners, as the case may be, of the advertised number of prizes available in the prize category in question may be selected in a random drawing from among all persons making purportedly valid claims for such prize(s).  Inclusion in such drawing shall be each entrant’s sole and exclusive remedy in such circumstances.

 

By entering the Sweepstakes, you further agree that (a) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prize awarded, shall be resolved individually without resort to any form of class action; (b) any claims, judgments and awards shall be limited to reasonable and actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorney's fees; and (c) under no circumstances will you be permitted to obtain any award for, and you hereby waive all rights to claim, punitive, incidental, indirect or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for reasonable and actual out-of-pocket expenses.  These rules and any disputes relating hereto are governed by the internal laws of the State of New York without regard to principles of conflicts of laws, and by entering, you consent to the exclusive jurisdiction of the state and federal courts in the State of New York for resolution of any disputes relating to the Sweepstakes and waive any objection thereto.

Winner’s Name.  For the winner’s name, available approximately 15 days after the Entry Period closes, please visit the Giveaway Page in the App or contact Sponsor by email at giveaways@jackpocket.com and include the name of the Sweepstakes in your email.  All such requests must be received within 60 days after the Entry Period.
